1. Acceptance of Terms

By booking a tour, submitting a reservation request, making a payment, or participating in any Sharky Tours activity, you acknowledge that you have read, understood, and agree to these Terms & Conditions. These terms constitute a legally binding agreement between you and Sharky Tours LLC and affect your legal rights.

2. Eligibility & Participation

Participants must follow all instructions provided by the captain and crew.

Sharky Tours LLC reserves the right to refuse service to any individual who appears impaired, poses a safety risk, or fails to comply with safety rules. Minors must be accompanied by a parent or legal guardian unless otherwise approved in writing.

 

3. Assumption of Risk

You understand that boating and water-based activities involve inherent risks, including but not limited to:

Weather conditions

Slippery surfaces

Wildlife encounters

Vessel movement

Physical exertion

By participating, you voluntarily assume all risks associated with the activity, whether known or unknown.

 

4. Release of Liability & Waiver

To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless Sharky Tours LLC, its owners, captains, crew members, employees, agents, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities arising out of or related to participation in any Sharky Tours activity, including but not limited to personal injury, property damage, or death. This release applies to you, your heirs, assigns, successors, and representatives.

 

5. Weather & Safety Cancellations

Safety is our top priority. Tours may be delayed, modified, or canceled due to weather, mechanical issues, or unsafe conditions. In the event Sharky Tours cancels a trip for safety reasons, guests will be offered a reschedule or refund at our discretion. Weather-related discomfort does not qualify for refunds once the tour has departed.

 

6. Booking, Payments & Cancellations

Full or partial payment may be required at the time of booking. Cancellation policies will be communicated at the time of booking and may vary by tour type. No-shows or late arrivals may result in forfeiture of payment. Refunds are not guaranteed for early returns or shortened trips.

 

7. Guest Responsibilities

Guests agree to:

Arrive on time

Wear appropriate attire

Follow all safety instructions

Respect the vessel, equipment, crew, and environment

 

Guests may be held financially responsible for damage caused by negligence or misconduct.

 

8. Alcohol, Drugs & Prohibited Items

Illegal drugs are strictly prohibited. Alcohol consumption is subject to captain approval and applicable laws. Sharky Tours LLC reserves the right to terminate a tour without refund if unsafe behavior occurs.

 

9. Photography & Media Release

By participating in a Sharky Tours experience, you grant permission for photographs or videos taken during the tour to be used for promotional, marketing, and social media purposes unless you notify us in writing prior to the tour.

 

10. Health & Medical Considerations

Guests are responsible for assessing their own physical condition and ability to participate. Sharky Tours LLC is not responsible for medical conditions aggravated during the tour. Guests should disclose relevant medical concerns before departure.

 

11. COVID-19 & Communicable Illness Disclaimer

By participating in a Sharky Tours activity, you acknowledge that exposure to communicable illnesses, including COVID-19, is an inherent risk of public activities. You voluntarily assume this risk and agree to release Sharky Tours LLC from any related claims. Sharky Tours will continue to follow applicable local and state guidelines.

 

12. Limitation of Liability

To the maximum extent permitted by law, Sharky Tours LLC’s liability shall not exceed the total amount paid for the tour. Under no circumstances shall Sharky Tours LLC be liable for indirect, incidental, or consequential damages.

All website content is the property of Sharky Tours LLC. Unauthorized use, reproduction, or distribution is prohibited. Website information is subject to change without notice.

 

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of North Carolina.
